Terms of Service

1. Who you are contracting with
These Terms of Service ("Terms") are a binding agreement between you and HomesteadHQ("HomesteadHQ", "we", "us", or "our"), the operator of the HomesteadHQ home-management service available at this website and its subdomains (the "Service"). References to "you" mean the individual or entity using the Service.
2. Acceptance of these Terms
By creating an account, accessing, or continuing to use the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. The Service
HomesteadHQ helps you track homes, appliances, maintenance tasks, contractors, and documents. Some features are only available on a paid plan. We may add, change, or remove features from time to time and do not guarantee that the Service will be uninterrupted or error-free.
4. Accounts and acceptable use
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date.
You will not:
- use the Service for any unlawful, fraudulent, or misleading purpose;
- upload malware, attempt to gain unauthorized access, probe, scan, or otherwise interfere with the security or integrity of the Service;
- scrape, reverse engineer, resell, or redistribute the Service or circumvent its technical limits;
- infringe the intellectual property, privacy, or other rights of any third party.
5. Intellectual property
The Service, including all software, content, branding, and documentation, is owned by HomesteadHQ or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with your plan and these Terms. You retain ownership of the content you upload; you grant HomesteadHQ a limited license to host, store, and process that content solely to provide and improve the Service.
6. Payments, subscriptions, and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Your purchase is therefore also governed by Paddle's Checkout Buyer Terms, which cover billing, taxes, currency, payment methods, cancellations, and refunds.
Paid plans are billed in advance on a recurring basis (monthly or yearly, depending on the plan you select) and renew automatically until cancelled. You may cancel at any time from your account page; cancellation takes effect at the end of the then-current billing period, and you keep access to paid features until that date. Refunds are handled by Paddle in accordance with our Refund Policy.
7. Suspension and termination
We may suspend or terminate your access to the Service, in whole or in part, if you materially breach these Terms, fail to pay amounts due, present a security or fraud risk, or repeatedly or seriously violate our policies. On termination, your right to use the Service ends immediately; we will give you a reasonable opportunity to export your data before deletion, except where prompt deletion is required by law or to protect the Service.
8. Disclaimers and limitation of liability
The Service is provided "as is" and "as available". To the fullest extent permitted by law, HomesteadHQ disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, HomesteadHQ's aggregate liability arising out of or relating to the Service will not exceed the amounts you paid to us (via Paddle) in the twelve months preceding the event giving rise to the claim. We will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill. Nothing in these Terms excludes liability that cannot be excluded by law (for example, for fraud, death, or personal injury caused by negligence).
9. Indemnity
You will defend and indemnify HomesteadHQ against third-party claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which HomesteadHQ is established, without regard to conflict-of-laws principles. Nothing in these Terms limits mandatory consumer protections available to you in your country of residence.
